Part A – Packages and Vouchers
1. Scope and Application
1.1. These General Terms & Conditions (“GTC”) govern the legal and contractual relationship between Nürburgring eRacing SA (hereinafter “NÜRBURGRING eSports”) and the purchaser of driving packages, vouchers, or other merchandise (hereinafter “Customer”).
1.2. These GTC apply to all event locations (“Stores”) operated by NÜRBURGRING eSports and to its online offer for the purchase of driving packages (“Packages”).
1.3. Prior to purchase, the Customer is informed about the validity of these GTC. By proceeding with the purchase, the Customer fully accepts them. These GTC apply exclusively to end customers and users of the services offered by NÜRBURGRING eSports.

2. Services of NÜRBURGRING eSports
2.1. NÜRBURGRING eSports sells variously timed driving packages on racing simulators (“Packages”) both in its Stores and online. Additionally, vouchers (“Vouchers”) transferable to third parties may be purchased in the Stores or online for different Packages.
2.2. Packages are booked for a specific time slot (“Time Slot”), chosen or indicated by the Customer during purchase. Based on the booking, the Customer may use the agreed services at the designated Time Slot in the Stores. Vouchers can be redeemed at any time during the Stores’ regular opening hours.
2.1. NÜRBURGRING eSports sells variously timed driving packages on racing simulators (“Packages”) both in its Stores and online. Additionally, vouchers (“Vouchers”) transferable to third parties may be purchased in the Stores or online for different Packages.

3. Conclusion of Contract
3.1. The contract for the purchase of Packages or driving sessions is concluded exclusively with NÜRBURGRING eSports as soon as NÜRBURGRING eSports accepts the Customer’s order (e.g., upon on-site payment, sending an electronic confirmation of the booked Package, or issuing a confirmation at the end of the purchase process).
3.2. NÜRBURGRING eSports reserves the right to refuse contract conclusion if there are outstanding claims against the Customer or if any irregularities related to the contract are discovered.
3.3. Minors cannot use the online offer. The purchase of Packages by minors is only possible on site upon presentation of valid proof of age, in accordance with applicable youth protection laws. In the absence of proof, NÜRBURGRING eSports may refuse service, refunding the corresponding purchase price.

4. Payment
4.1. Once the offer is accepted, the corresponding payment becomes immediately due. The statutory VAT in effect at the time is included in the stated price, which represents a retail price.
4.2. Payment can be made on site, via PayPal, or by credit card. NÜRBURGRING eSports reserves the right to add or remove payment methods at its discretion, informing the Customer prior to contract conclusion.

5. Transfer of Ownership and Voucher Redemption
5.1. Ownership of the ticket or Voucher is transferred to the Customer either in the Store or through an electronic confirmation of the Time Slot or Voucher.

6. Customer Obligations, Proper Use of Simulators, and Media Consent
6.1. The Customer must validate the purchase by presenting a printout of the confirmation or an electronic proof on a mobile device.
6.2. Proper Use of Simulators:
a) The Customer must strictly follow all operational instructions and safety guidelines provided by NÜRBURGRING eSports staff.
b) The Customer acknowledges the inherent risks of using simulators and agrees to operate them only as directed. Any damage arising from improper, careless, or negligent use shall be borne solely by the Customer.
6.3. Consent to Photography/Videography:
a) By entering the premises and using our services, the Customer expressly consents to being photographed or recorded (audio/video) during the session.
b) NÜRBURGRING eSports may use such images and recordings for promotional and marketing purposes (website, social channels, etc.) without providing additional compensation.
c) If the Customer does not wish to be photographed/recorded, they must inform staff before the session begins. Reasonable measures will be taken, but total exclusion from recordings cannot be guaranteed.

7. Cancellation/Revocation and Goodwill Refund
7.1. The right of withdrawal or revocation does not apply to Packages, as they are leisure activities booked for a specific period (§ 312g Abs.2 Nr. 9 BGB). Nonetheless, NÜRBURGRING eSports may, at its sole discretion, allow the Customer to use the service after the booked period as a gesture of goodwill, with no resulting legal claim.
7.2. For Vouchers that are not time-bound, the Customer has a fourteen-day right of revocation from the day the Customer or a designated third party (not the carrier) takes possession of the goods. To exercise this right, the Customer must notify NÜRBURGRING eSports (e.g., by letter or e-mail). NÜRBURGRING eSports will then refund all payments (including delivery costs, except for additional costs arising from a non-standard delivery option) within fourteen days, using the original payment method. Reimbursement may be withheld until the goods are returned or proof of return is provided.

9.1. To the fullest extent permitted by law, NÜRBURGRING eSports excludes any liability. This exclusion does not apply where liability is mandatory by law (e.g., under the Product Liability Act), in cases of intent or gross negligence, personal injury, or breaches of essential contractual obligations.
9.2. NÜRBURGRING eSports is not liable for slight negligence unless it results in personal injury or arises under the Product Liability Act.

11. Final Provisions and Jurisdiction
11.1. All communications regarding the contract must be made in writing (letter, e-mail, fax). NÜRBURGRING eSports’ contact details are provided in the website’s imprint or cancellation policy.

If the Customer is an entrepreneur, these GTC and the contract with NÜRBURGRING eSports are governed by the substantive law of the Swiss Confederation, excluding the UN Convention on Contracts for the International Sale of Goods. If the Customer is a consumer, the applicable law is that of the country in which the Customer has his/her habitual residence.
11.3. For Customers who are entrepreneurs or merchants, the courts of the city in which the Lounge is located shall have exclusive jurisdiction over any dispute arising from or related to the contract.
11.4. The European Commission provides an Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr/. NÜRBURGRING eSports is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

1.1. These Membership Terms & Conditions (“GTC Membership”) apply exclusively to the use of racing simulators (“Simulators”) by members (“Members”) under a paid membership. They complement, but do not replace, Part A unless otherwise expressly stated.
1.2. NÜRBURGRING eSports reserves the right to amend these GTC Membership for future contracts upon valid reason (e.g., legislative changes, court rulings, technical requirements). In such cases, the Member will be notified of the amendment and granted a six-week period to accept or object. Failure to object in writing or to terminate within that timeframe results in the amendment becoming effective. Changes to essential contractual obligations are excluded.

3. Eligibility

For claims, disputes, or matters concerning services at a specific location, the responsible entity is that which operates the respective location. The relevant entity will be indicated on site and/or in related communications.
